IVA (Individual Voluntary Arrangement)

An IVA is a legally-binding arrangement between you and your creditors writing off up to 75% of your debts. An IVA means reaching a compromise with your creditors to settle your debts within a reasonable and fixed period of time at the same time avoid the consequences of bankruptcy. An individual who is intending to propose an IVA can apply for an Interim Order, the interim order basically prevents all creditors from pursuing any legal proceedings against you. If legal proceedings have been commenced, then they are frozen at the stage they have reached.

Informal Repayment Plan

An Informal Debt Repayment Plan is an agreement with your creditors to reduce the amount you pay to them each month so that the payments fit within an affordable monthly budget.
The plan is known as “informal” because it is not legally binding on your creditors.

Bankruptcy

It is normally seen as a last resort to solve your debt problems. If you are declared bankrupt, you will no longer have to repay your creditors yourself and the court will protect you from any further actions that your creditors threaten against you. With bankruptcy your assets (property, shares, anything of real value or even non-essential) can be sold to pay your creditors.

Bailiffs

DO NOT invite the bailiff/person into your house.
They may ask if they can discuss things inside your home or they may try and march in as soon as you answer the door. If they gain peaceful entry they have free access to your house and can enter with force on the second visit All bailiffs must carry identification. Always ask for it and for a copy of the warrant they are collecting. Some creditors will send people around to your house who are not bailiffs to try and get payment from you. On the first visit a bailiff cannot use force to gain entry into your home. They can only enter via what is known as peaceful entry. Entering through an unlocked door or window this would be allowed as peaceful entry. Pushing their way past you at the front door is a forced entry and is not permitted. Bailiffs should know these rights but you should be aware they may try to gain entry by asking you to let them come in to discuss things.

CCJs (County Court Judgments)

If you are being threatened with a CCJ but do not have the money to repay your debt in full, you must try to agree a reduced repayment plan before you receive the CCJ. You have 14 days from the date you receive a C C Claim form to pay off our debt.
